02 Jun El Supremo estima el recurso de los perjudicados por un incendio
El Pleno de la Sala I del Tribunal Supremo estima el recuso de los perjudicados por un siniestro que tuvo lugar en Tarragona en el año 2005.
El incendio se produjo debido a una acumulación de gas en una vivienda de Tarragona, y causó el fallecimiento de cinco personas, cuatro de ellas de la misma familia, y lesiones a un viandante. También se ocasionaron daños materiales en tres vehículos.
La sentencia de primera instancia, así como la dictada por la Audiencia de Tarragona, habían estimado parcialmente las demandas, exonerando a Gas Natural y a su aseguradora, aduciendo que no se había acreditado ni que la fuga de gas se debiera a un defecto en la instalación que la empresa hubiera debido detectar, ni que la explosión no se hubiese producido igualmente aunque se hubiera realizado la inspección reglamentaria correspondiente.
El Supremo considera que esta segunda afirmación contradice el principio de la carga probatoria, trasladándola a quien carece de medios para probar lo contrario.
También considera el Supremo que no se ha tenido en cuenta el principio de responsabilidad por riesgo, que aunque no es de carácter plenamente objetivo salvo en los casos en que así venga establecido por ley, obliga a quien presta el servicio generador del riesgo a acreditar el verdadero origen del siniestro.
